Terms of use
Most important. Eticko is an information tool, not medical advice. Product and allergen data comes from a community database and may be incomplete, out of date or wrong. Always read the pack, especially if you have an allergy, and ask a doctor before making decisions about your health.
1. Who we are
Eticko is published by a sole trader registered in Portugal (“we”). The full name, postal address and phone number are shown as the trader information on the Eticko page in the App Store and in the app under Settings › About and attribution › Trader information. Contact: [email protected].
2. These terms and Apple’s licence
The app is licensed to you under Apple’s Licensed Application End User License Agreement. These terms add to it. By using Eticko you accept both. If you do not agree, please do not use the app.
3. What the score is
The Eticko score from 0 to 100 is calculated on your iPhone from data in Open Food Facts, by a public method. It describes the product data. It is not a statement about your health, not a diagnosis and not a recommendation to eat or avoid a product. When data is missing, the app says so and shows no score or a provisional one.
Better alternatives are selected by score only. No one pays for a place in the list, for a score or for any other position in Eticko.
4. Allergen and diet warnings
- Warnings rely on the ingredients and allergen information in Open Food Facts, or on what the app reads from your photos. That information may be incomplete, out of date or wrong.
- No warning does not mean a product is free of an allergen. Eticko never confirms that a product “does not contain” anything.
- Always read the label on the pack itself. If you have a severe allergy or a medical diet, rely on the label and on your doctor, not on the app.
5. Product data and corrections
Product data is provided by Open Food Facts contributors under the Open Database License (ODbL); individual contents under the Database Contents License (DbCL); product photos under Creative Commons BY-SA. Eticko reads this data as it is and does not check every product.
Anyone, including producers, can report an error from the app or by email. We reply within 14 days and fix confirmed errors in Open Food Facts.
6. What you send to Open Food Facts
You can send missing products to Open Food Facts with your own Open Food Facts account. Open Food Facts’ terms of use apply to that. What you send is published under ODbL, DbCL and CC BY-SA and cannot be withdrawn. Send only photos you took yourself, of the product and its label, without people in them.
7. Premium
- Scanning, search, alternatives and allergen warnings are free. Premium adds your own lists, diet warnings, and search and export of your history.
- Premium is offered as a yearly subscription or as a one-time purchase. The price and period are shown in the app before you buy, in your local currency.
- The yearly subscription renews automatically unless you turn off renewal at least 24 hours before the end of the current period. You manage and cancel it in your Apple ID settings (Settings › your name › Subscriptions).
- Purchases are made, charged and refunded by Apple under the App Store terms. Your rights as a consumer, including the right of withdrawal, apply through Apple as the seller. Use “Restore purchases” in the app to get Premium back on a new iPhone.
- Premium is shared with your family through Family Sharing.
8. Fair use
Use Eticko for your own information. Do not misuse it, interfere with it, or use it to send unlawful or misleading content to Open Food Facts. The app, its name, design and texts are ours, except open data and open-source parts, which remain under their own licences.
9. Liability
We take care that Eticko works and calculates correctly, but we cannot guarantee that product data is complete or correct, or that the app is always available. To the extent the law allows, we are not liable for decisions made on the basis of the score or of warnings, or for errors in data from Open Food Facts.
Nothing in these terms limits liability that cannot be limited by law, in particular for intent, gross negligence, or injury to life, body or health, and nothing limits your mandatory rights as a consumer.
10. Law and disputes
Portuguese law applies. If you are a consumer, you also keep the protection of the mandatory law of the country where you live, and you can bring a claim in the courts there. Please write to us first; most questions are solved by email. You can also turn to a consumer dispute resolution body; information is available on the Portuguese consumer portal www.consumidor.gov.pt and at the consumer authority in your country.
11. Changes
We may update these terms, for example when features change. The date above shows the current version. Important changes are announced in the app before they apply.
